Ministry of Government Legislation Provides Standard Model for Ordinance Application to 137 Local Governments

View original image[Asia Economy Reporter Moon Chaeseok] On the 11th, the Ministry of Government Legislation announced that it provided two standard models applicable to ordinances to 137 local governments.
This measure was taken to prevent residents from experiencing inconvenience due to legislative gaps in ordinances and the failure to timely reflect amendments of higher-level laws in ordinances. The two models can be referenced when drafting 454 ordinances.
On the 15th of last month, the Ministry of Government Legislation issued the first notification of a standard model related to the extension of expiration periods for 347 fund-related ordinances whose duration is set to expire within the next six months.
This was inspired by the fact that local governments set a duration of existence within five years when basing funds on ordinances.
The measure aims to prevent the loss of the operational basis of funds by allowing local governments to draft ordinance amendments before the expiration of the duration.
On this day, the Ministry issued a second notification of a standard model concerning the limitation on the number of times enforcement fines can be imposed. This is to strengthen enforcement against buildings that repeatedly violate laws.
Although the amendment to the Building Act last year removed the total limit on the number of enforcement fines imposed on small-scale housing, 107 local governments' building ordinances failed to reflect this. Therefore, restrictive provisions still remain, prompting this action, explained the Ministry of Government Legislation.
