Attorney A, who has experience exclusively handling warrant reviews during their time as a judge, said, "It is difficult to know the judge's true intention, but generally, it is hard to equate basic facts with criminal facts." For example, in a fraud case, basic facts refer to the straightforward foundational facts such as "the victim gave money to the suspect." However, it is difficult to interpret this as including criminal facts such as "whether there was intent to defraud from the moment the money was requested" or "whether there was a deceptive act constituting fraud," according to Attorney A's interpretation.
However, the prosecution's perspective is completely different. Prosecutor B said, "Although ambiguous expressions were used, when comprehensively interpreting the following phrases such as 'the prosecution has secured evidence' and 'it is appropriate to decide during the trial process,' it can be understood that the criminal charges have been proven." Judge C also said, "It seems more like a lack of necessity and appropriateness for detention rather than a lack of proof of criminal charges."
Regarding the phrase "the prosecution has secured evidence," Attorney A analyzed, "The evidence could be either for guilt or innocence, but the prosecution has sufficiently investigated and secured most of the evidence, so they wanted to say that the risk of evidence tampering is unlikely to be grounds for detention."
Meanwhile, Chief Judge Won issued an arrest warrant for Jo Joo-bin, the operator of the "Baksa Room," in March, using the phrase "a considerable part of the criminal charges has been proven."
