Doctor Sentenced to 3 Years and 6 Months for Killing Baby Born During Abortion Surgery (Comprehensive)

The Seoul Central District Court Criminal Division 25-1 (Presiding Judge Sunhee Kim) on the 10th sentenced obstetrician-gynecologist A, who was charged with murder and other offenses, to 3 years and 6 months in prison and a 3-year suspension of medical license.
A, the director of an obstetrics and gynecology clinic in Seoul, was arrested and indicted on charges of attempting to abort a fetus at 34 weeks of pregnancy by cesarean section last March, but deliberately caused the baby to die after it was born alive.
In court, A admitted to performing an illegal abortion procedure and mutilating the baby's body, but denied the prosecution's claim that the fetus was healthy at the time of the procedure or that the survival probability was high.
