Couple Accused of Assaulting Upstairs Neighbor Over Noise Complaint Acquitted: "No Proof of Injury"
[Asia Economy Reporter Kim Hyung-min] A couple who seriously injured their upstairs neighbors during a fight over noise between floors was acquitted in the Supreme Court's final trial.
The Supreme Court's 2nd Division (Presiding Justice Noh Jeong-hee) announced on the 3rd that it upheld the lower court's verdict of not guilty in the appeal trial of the couple, A (46) and B (43), who were charged with violating the Act on the Aggravated Punishment, etc. of Specific Crimes (joint injury).
A lived in an apartment in Chungbuk and fought with the upstairs couple in September 2017 due to ongoing conflicts over noise between floors. During this altercation, A caused injuries to the upstairs couple and was brought to trial. The upstairs wife, C, was hospitalized after the fight and received a diagnosis of a three-week recovery period. The couple A claimed self-defense, stating that they were the ones assaulted.
The first trial sentenced the couple A to a fine of 800,000 won each, based on C's injury medical certificate and torn clothing from the fight. However, the second trial acquitted them, stating, "It cannot be concluded beyond a reasonable doubt that the couple A inflicted injury." It also noted, "Considering that C did not appear to have received significant treatment for this incident, it is difficult to conclude injury solely based on the medical certificate."
