A 20-Year-Old Sentenced to Prison for Wielding a Weapon at Police Officer After Causing Disturbance at Home
Treated for Schizophrenia Since 2004... Court Recognizes Diminished Mental Capacity and Orders Treatment Custody
[Asia Economy Reporter Jeong Dong-hoon] A man in his 20s who caused a disturbance at home and injured police officers by wielding a weapon has been sentenced to prison.
The Criminal Division 11 of the Seoul Western District Court (Chief Judge Jo Byung-gu) announced on the 10th that Kim Mo (29), who was detained and prosecuted on charges of attempted murder and special obstruction of official duties causing injury, was sentenced to 2 years and 6 months in prison and ordered to receive medical treatment and custody.
Kim is accused of causing a disturbance at his home in Yongsan-gu, Seoul, in July last year. His mother called 112 and reported, "My son keeps making strange noises, please come and just warn him." When the police arrived, Kim became enraged and attempted to kill Police Officer A by wielding a weapon.
Later, when Sergeant B and other officers who responded to the support request tried to arrest him, Kim again wielded a weapon, injuring Sergeant B.
As a result of Kim's crimes, Officer A sustained injuries requiring 7 weeks of treatment, and Sergeant B sustained injuries requiring 2 weeks of treatment.
Kim has been receiving treatment for schizophrenia since 2004. The psychiatrist responsible for his mental evaluation stated, "Due to schizophrenia, his ability to distinguish objects and make decisions is impaired, and if specialized psychiatric treatment is not provided, there is a possibility of reoffending, so medical treatment and custody are necessary."
The court pointed out that Kim "committed the crime while in a state of diminished capacity to distinguish objects or make decisions due to schizophrenia," but also noted that "he wielded a weapon against the police officers who arrived at the scene, causing injuries, and even after being detained, he committed acts of assault and obstruction of official duties at the Seoul Southern Detention Center and Gongju Medical Custody Center. The severity of each offense is significant, and he has not reached a settlement with the victims."

The court continued, "At the time of the crime, the defendant appeared to be in a state of severe mental and physical disability. Although the crime is very serious, the principle of responsibility cannot be ignored when determining the sentence," and explained the sentencing rationale by considering "the fact that he admitted to all the crimes and has no prior criminal record as mitigating factors."
