Court Rules "No Infringement of Plaintiffs' Legal Interests"
Goyang City Changes Onemount Urban Management Plan to Revitalize Local Economy
The Uijeongbu District Court has ruled in favor of Goyang City in the lawsuit seeking to cancel the "Announcement of the Decision to Change the Urban Plan for Onemount."
On September 30, the court dismissed the lawsuit filed by some Onemount members seeking to overturn the decision to change the urban management plan, stating, "It is difficult to see that the plaintiffs and others have had their interests, which are directly and specifically protected by law, infringed upon."
In February of this year, the city announced a decision to change the urban management plan to revitalize the local economy in the Onemount and KINTEX areas. The designated use of the building was changed from "at least 60% sports facilities" to "at least 60% sports and retail facilities." The proportion of sports facilities, excluding retail facilities, was adjusted to at least 40% of the total above-ground floor area, and some permitted uses were relaxed.
From August to November of last year, the city followed proper administrative procedures in accordance with relevant laws during the process of changing the urban management plan. This included consultations with relevant departments and agencies, public inspection and notification, and review by the Urban and Architectural Joint Committee. During the public inspection period, some residents also submitted statements in support of the change.
However, there were also opposing opinions during this process.
Some residents argued that, since the rehabilitation proceedings for Onemount Co., Ltd. were underway, the decision to change the urban management plan posed a significant risk of infringing on property rights and failed to properly balance public and private interests. In March, they filed a lawsuit with the Uijeongbu District Court seeking to cancel the decision to change the urban management plan.

In response, the city submitted a written statement to the court in April, asserting that the change in the urban management plan was decided through lawful administrative procedures and did not infringe on property rights or harm the public interest. In June, city officials appeared in court to present arguments. The city also requested the court to rule on the plaintiffs' legal standing, and the court accepted Goyang City's position and dismissed the case.
