Supreme Court: "Hanyang Has No Construction Rights for Gwangju Central Park District 1"
Hanyang lost the lawsuit over the apartment construction rights dispute surrounding the 'Central Park District 1 Private Park Special Project' in Gwangju Metropolitan City.
According to industry sources on the 17th, the Supreme Court's 3rd Division dismissed Hanyang's appeal in the final trial of the lawsuit filed by the special purpose company (SPC) Bitgoeul Central Park Development (with Lotte Construction as a supporting participant) to confirm the non-existence of construction company status, ruling in favor of the plaintiff as in the first and second trials.
Lotte Construction signed a construction contract as the contractor for the project in April 2021, but Hanyang filed a lawsuit claiming that they were the sole construction company.
However, the court ruled that the SPC had properly followed procedures to sign the contract with Lotte Construction and found no legal grounds for Hanyang to claim construction rights.
A representative of Bitgoeul Central Park Development stated, "This Supreme Court ruling proves that Hanyang has been making indiscriminate claims without legal basis. The impact on the outcomes of other lawsuits will also be significant."
They added, "Since the legitimacy of the Central Park District 1 project has been legally recognized, Hanyang's claims can now be seen as malicious obstruction. The project can proceed normally from now on."
The 'Central Park District 1 Private Park Special Project' is a development project to build park facilities and non-park facilities on a 2,435,027㎡ area covering Geumho-dong, Hwajeong-dong, and Pungam-dong in Seo-gu, Gwangju Metropolitan City.

On the non-park facility site, a total of 2,772 apartment units across 39 buildings ranging from three basement floors to 28 above-ground floors are planned. Lotte Construction succeeded in raising approximately 1 trillion KRW in project financing (PF) last September and is currently proceeding with construction.
