An 80-Year-Old Man Who Took Viagra and Sexually Assaulted an Elementary School Student Faces 20 Years in Prison

A former offender who committed child sexual abuse in the past and received leniency has now been brought to trial on charges of child rape, with the prosecution seeking a heavy sentence of 20 years in prison.

[Asia Economy Reporter Kim Jung-wan] The prosecution has requested a heavy sentence of 20 years imprisonment for an 84-year-old man who was arrested and indicted for dragging an 11-year-old elementary school student he met on the street to his home and sexually assaulting her.
According to the prosecution on the 21st, at a trial held the previous day at the Criminal Division 1 of the Uijeongbu District Court Namyangju Branch, the prosecution requested the court to sentence Kim (84), who was arrested and indicted on charges of violating the Act on the Protection of Children and Juveniles Against Sexual Abuse, the Special Act on the Punishment of Sexual Crimes, and abduction for sexual purposes, to 20 years in prison.
The prosecution also requested a 20-year electronic location tracking device attachment, 10 years of completion of a sexual violence treatment program, 10 years of notification of personal information disclosure, 10 years of employment restriction at institutions related to minors, and 10 years of probation.
The prosecution explained the reason for the sentence, saying, "The defendant has a history of repeatedly molesting minor girls, yet committed the crime again. He planned the crime after taking erectile dysfunction medication, has not been forgiven by the victim, denies the crime, and shows no remorse, so a severe punishment is necessary."
Kim, a retired public official, was brought to trial on charges of dragging an 11-year-old elementary school student he met on the street to his home on the morning of April 27 and sexually assaulting her multiple times. Kim's side admitted to molesting the student but denied some charges, claiming "there was no erection, so rape cannot be established."
However, the prosecution stated in the indictment that Kim dragged the victim to the master bedroom, stripped her completely, raped her, and repeatedly raped her even after she went to the bathroom.
It was investigated that Kim took Viagra before the crime, and during the investigation, he reportedly stated, "My wife was in the hospital, so I was depressed and momentarily wanted to touch a girl."
Kim was also found to have prior convictions for sexually molesting children under 13 in 2017 and 2018. At that time, the court ruled not to disclose his personal information and did not attach an electronic tracking device.
During the 2017 case, the court sentenced Kim, who touched an elementary school student's body, to 2 years and 6 months in prison with a 3-year probation, stating, "He is elderly in his 80s and lived diligently as a public official." Regarding the disclosure of personal information, the court decided not to disclose it, considering his age and social ties.
When he was indicted again in 2018 for sexual molestation, the court fined Kim 40 million won. At that time, the prosecution requested the attachment of an electronic location tracking device, stating, "The defendant committed sexual violence more than twice," but the court did not accept it. Personal information was also not disclosed in that ruling.
