Prosecution Uses Scientific Investigation Techniques Including DNA Analysis to Prove 'Forced Molestation Resulting in Death and Corpse Abandonment'
[Asia Economy Reporter Heo Kyung-jun] The prosecution has appealed the first trial's heavy sentence against a man in his 70s who sexually assaulted, murdered, and disposed of the body of a middle school classmate.
On the 13th, the Gunsan Branch of Jeonju District Prosecutors' Office announced that it had appealed the original verdict, which recognized only the preliminary charges of involuntary manslaughter by sexual assault and corpse abandonment as guilty and sentenced A (73) to 13 years in prison on charges including violation of the Special Act on the Punishment of Sexual Violence Crimes (rape and murder).
A was indicted on charges of sexually assaulting B (then 73, female), a middle school classmate, at his home in Iksan on April 4-5 last year, beating her to death, and abandoning her body near the helicopter landing site on the 7th ridge of Mireuksan Mountain in Iksan, Jeonbuk.
Earlier, the prosecution received the 'Iksan Mireuksan corpse abandonment case' and through supplementary investigations including detailed CCTV analysis during detention, on-site verification, and forensic medical consultation, uncovered that A sexually assaulted B before killing her. During the trial, they analyzed bloodstain DNA at the crime scene and submitted it as additional evidence, maintaining the prosecution for 1 year and 3 months, resulting in A receiving a heavy sentence of 13 years in prison.
During the investigation, the prosecution confirmed that A had received treatment for a 'tongue laceration' before abandoning the body and sought forensic medical advice from the doctor and dentist who treated A, as well as a forensic medicine professor, obtaining an opinion that 'it is judged that the tongue was bitten by another person.'
Based on this fact, the prosecution judged that A beat B to death after B bit his tongue when he forcibly tried to kiss her, and charged him with forced sexual assault murder under the Sexual Violence Punishment Act. It is reported that A claimed during the investigation that he injured his tongue by falling.
Even while the trial was ongoing, the prosecution employed various forensic techniques to prove the motive, time of the crime, and cause of death, leading to a guilty verdict. Through re-examination by the DNA and Chemical Analysis Division of the Supreme Prosecutors' Office, the bloodstains of A and B left at the scene were distinguished and identified. This proved that B bled heavily due to A's assault and that A bled at the scene from the tongue laceration.
Ultimately, last month during the trial, the prosecution added the preliminary charges of involuntary manslaughter by sexual assault and corpse abandonment and sought a life sentence for A, but the court acquitted him of the charges of violation of the Sexual Violence Punishment Act (rape and murder) and sentenced him to 13 years in prison.

A prosecution official said, "We have appealed the first trial verdict to contest the acquittal on the murder charge and the sentencing," adding, "We will do our utmost to maintain the prosecution in the appellate trial so that the defendant receives punishment commensurate with the crime."
