"50-Year-Old Charged with Drunk Driving Found Not Guilty After Falling Asleep in Car After Drinking"
[Asia Economy Reporter Seoyoung Kwon] A man in his 50s who was accused of drunk driving after falling asleep in his car after drinking alcohol was acquitted.
Today (28th), the Chuncheon District Court Criminal Division 2 (Presiding Judge Jinyoung Park) announced that A (53), who was indicted for drunk driving and driving without a license under the Road Traffic Act, was found not guilty.
Previously, A was prosecuted for driving a passenger car without a license on a road in Chuncheon City on September 7 last year, driving about 30 meters with a blood alcohol concentration of 0.152%.
However, A's side claimed that he had parked the car after driving without drinking. A explained that after drinking at a nearby pojangmacha, he only turned on the car's engine and fell asleep, and was later subjected to a sobriety test.

Judge Park ruled that the fact that the reporter called 112 saying, "A car is running with the engine on and the driver is collapsed. It is unknown whether he is drunk," and that the police arrived and conducted a breathalyzer test, is insufficient to conclude that A was driving under the influence. He also stated, "It is insufficient to reject the defendant's claim and recognize that he was driving, and there is no evidence to support this."
