Hampyeong-gun Actively Promotes Real Estate Special Measures Act 'Only 1 Year Left'
Implemented in August last year... Regain property rights through simple procedures
[Hampyeong=Asia Economy Honam Reporting Headquarters Reporter Kim Chunsu] Hampyeong County, Jeollanam-do announced on the 11th that there is about one year left in the operation period of the "Special Act on Real Estate Ownership Transfer Registration, etc." (hereinafter referred to as the "Special Act"), which has been temporarily implemented for two years since August last year, and has started promoting it.
This law is a special act that allows real estate without ownership preservation registration or whose registry entries do not match the actual rights relationship to be registered through a simplified procedure.
The applicable targets are real estate that was effectively transferred by legal acts such as sale, gift, or exchange before June 30, 1995, inherited real estate, and real estate without ownership preservation registration.
Land under litigation regarding ownership attribution or applicants (corporations, non-corporate entities, Jongjung, etc.) who cannot acquire farmland under related laws such as the Farmland Act are excluded from the application.
The application method requires submitting a guarantee letter with the seals of at least five guarantors, including four general guarantors appointed by the town or township head and one qualified guarantor (lawyer or judicial scrivener), to the county office, and the application period is until August 4, 2022.
After investigating the purpose of issuing the guarantee letter and the facts, a two-month public notice and notification to interested parties will be conducted, and a confirmation certificate will be finally issued. By attaching this certificate and applying for ownership transfer registration at the responsible registry office, the real estate registration transfer will be completed.
Currently, Hampyeong County has received 648 confirmation certificates, completed issuance for 222 cases, and is conducting public notices and on-site investigations for the remaining 426 cases.
A county official said, "During the Korean War, the Yeonggwang Tax Office, which managed Hampyeong County’s cadastral records, was burned down, resulting in many real estate properties without ownership preservation registration," and added, "We hope that by conducting a thorough investigation of the land subject to the Special Act and posting it on the county website, more actual real estate owners will regain their rights."

Meanwhile, even if ownership transfer registration is made under this Special Act, violations under other laws such as the "Act on Registration of Real Rights in Real Estate" and the "Special Act on Real Estate Registration" may result in fines or penalties.
