Prosecutors Reject Request for Disciplinary Records of Prosecutors from the Corruption Investigation Office
[Asia Economy Reporter Park Hyungsoo] The Corruption Investigation Office for High-ranking Officials (CIO) requested a list of prosecutor misconduct cases, but the prosecution refused.
According to the legal community on the 30th, the CIO recently requested the Supreme Prosecutors' Office to provide a list and decision documents of high-ranking public official crime cases involving prosecutors that were dismissed between January 21 and May 31 of this year.
Article 25, Paragraph 2 of the Corruption Investigation Office Act requires other investigative agencies to transfer cases to the CIO if they discover allegations of high-ranking public official crimes involving prosecutors. The CIO requested the list to determine whether the prosecution closed cases without complying with the CIO Act.
The Supreme Prosecutors' Office refused to submit the materials, citing that the data essentially constitutes investigation history materials under the Act on the Expiration of Punishment, etc. Investigation history materials cannot be accessed except when necessary for criminal investigation or trial.
