Attempted Sexual Assault by Luring a Woman with Intellectual Disability Home with "Let's Drink Coffee" ... 70-Year-Old Sentenced to 4 Years in Prison
[Asia Economy Yeongnam Reporting Headquarters, Reporter Ju-cheol In] A man in his 70s who forcibly molested and attempted to sexually assault a woman with an intellectual disability after luring her to his home was sentenced to prison in the first trial.
The Criminal Division 1 of the Eastern Branch of Busan District Court (Presiding Judge Yeom Kyungho) announced on the 5th that it sentenced Mr. A, a man in his 70s who was indicted without detention on charges of violating the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (rape of a disabled person), to four years in prison.
The court also ordered Mr. A to complete an 80-hour sexual violence treatment program and imposed a three-year employment restriction at child and youth institutions and welfare facilities for the disabled.
Considering the current COVID-19 situation at Busan Detention Center, the court did not detain Mr. A in custody.
Mr. A was brought to trial on charges of luring Mr. B, a man in his 50s whom he met at church, to his home, forcibly molesting him, and attempting to sexually assault him. Mr. B suffered from a severe intellectual disability with a social age level equivalent to 10 years old.
In court, Mr. A claimed that he did not know Mr. B had a mental disability and that their relationship was consensual, but the court did not accept this.
During the trial, Mr. A even caused secondary harm to the victim and his family by asserting that Mr. B had an open sexual consciousness and attitude.
The court explained the sentencing by stating, “Considering the circumstances and content of the crime, Mr. A’s responsibility is not light, and he denied the charges while causing secondary harm to Mr. B and his family.”
The victim’s family said, “The victim still suffers from nightmares every day,” and added, “Although Mr. A knows the victim’s home, we feel anxious and disappointed because the sentence has not been immediately enforced due to the COVID-19 situation.”
