Male High School Student Expelled for Sexually Assaulting Middle School Student... Court Rules "Expulsion Justified"
[Asia Economy Intern Reporter Kim Seul-gi] A male high school student who was expelled for sexually assaulting a middle school girl filed a lawsuit against the decision but was dismissed by the court.
On the 6th, the Chuncheon District Court's 1st Administrative Division (Chief Judge Seong Ji-ho) announced that it dismissed A (20)'s lawsuit against B High School seeking to cancel his expulsion.
A sexually assaulted a female student of the same age in the same area twice during his first year of high school in 2017. As a result, A was expelled from his high school in October of the same year, but he filed a lawsuit against the decision.
A argued, "Since the victim attends a different school and there is no risk of further harm even if I continue attending school, and considering the severe disadvantages I would face, the expulsion is excessively harsh and unlawful."
However, the court stated, "A deliberately approached the victim and sexually assaulted her by force. This constitutes a serious criminal act and likely caused significant psychological distress to the victim. The school's decision to expel A, judging that there was little possibility of his rehabilitation, is deemed appropriate," and dismissed A's cancellation lawsuit.
Meanwhile, A, who was prosecuted for sexual assault, was sentenced to 4 years in prison with a minimum term of 3 years in the first trial, but in the second trial, he was sentenced to 3 years in prison with a 4-year probation.

The second trial court explained the sentencing by stating, "Considering that A paid a settlement to the victim's father and reached an agreement, and that the victim expressed a desire not to punish A."
