Class Action Act Delayed in Subcommittee Due to Ruling and Opposition Parties' Differences Over Retroactive Application

Bills on Recovery of Pro-Japanese Collaborators’ Property and Expedited Litigation Processed by Consensus

The handling of the Class Action Act has been postponed for now. Due to significant differences of opinion between the ruling and opposition parties regarding the retroactive application period and the scope of application, the bill was not processed in the National Assembly Legislation and Judiciary Committee's subcommittee on bills.


The Legislation and Judiciary Committee's subcommittee discussed the Class Action Act on April 29, but postponed the bill's processing due to differences in opinion between the parties.


Regarding the retroactive application period, the Democratic Party and the Rebuilding Korea Party insisted on retroactive application for up to three years. In contrast, the People Power Party raised concerns about retroactivity and reportedly requested further discussions. It was previously reported that the Democratic Party had decided not to push through the Class Action Act by force on this day. Kim Yong-min, a Democratic Party lawmaker who chairs the subcommittee, stated, "The timing of implementation was the main point of contention during the discussion."

Regarding the scope of class actions, the Democratic Party maintained that it should apply to all sectors, while the People Power Party expressed concerns about expanding the scope.


Additionally, the Democratic Party advocated for an opt-out system in which victims are automatically included unless they explicitly express their intent not to participate. On the other hand, it is reported that some within the People Power Party supported an opt-in approach, and the party's position has not been clearly finalized.


In the subcommittee, the parties reached an agreement and processed the Special Act on the Recovery of Property of Pro-Japanese Collaborators and the Act on Facilitating Litigation.
