The court has granted the injunction to suspend the validity of the exclusive contracts for nine members of The Boyz, excluding New, against their agency, One Hundred Label.
On April 24, Kim Munhee, an attorney at Yulchon LLC and legal representative for the nine members of The Boyz, announced, "The court decided yesterday to grant the injunction to suspend the validity of the exclusive contracts."
Regarding the court's reasoning, Kim explained, "The agency violated its obligation to pay settlement fees and failed to fulfill its duty to provide settlement documents necessary for verifying the appropriateness of the settlements." He added, "Furthermore, considering the agency's failure to fulfill core obligations under the exclusive contract, such as management support and the duty to protect the artists, the court recognized that the trust between the parties had been fundamentally damaged due to the agency's fault."
The agency argued that the contract payments made to the members were in the nature of 'advances,' but the court rejected this claim. Kim pointed out, "The court made it clear that the provisions for contract payments and the distribution of settlement fees arising from profits are defined as separate clauses in the exclusive contract," emphasizing, "Contract payments are compensation for entertainment activities offered to attract the artists, taking into account their recognition and value, and are clearly distinct from settlement fees."
Regarding future plans, Kim stressed, "The members will fulfill, in good faith and with a sense of responsibility, only those schedules that were confirmed before the termination of the exclusive contracts, in order to keep their promises to fans and minimize harm to any third parties acting in good faith."
The Boyz will faithfully carry out schedules that were confirmed prior to the termination of their exclusive contracts. Kim stated, "They will fulfill these commitments responsibly to keep promises made to fans and to minimize harm to any third parties acting in good faith."
