A woman in her 20s and her boyfriend have been put on trial for kidnapping, torturing, and robbing a victim in retaliation after a sexual assault case she had reported was closed with a finding of no charges. While the case could have been handled as a simple robbery and assault during the police investigation, a supplementary investigation by the prosecution revealed evidence that it was a premeditated crime aimed at forcing a false confession.

According to the legal community on April 24, the Criminal Division 2 of the Incheon District Prosecutors' Office (headed by Chief Prosecutor Yoon Wonil) indicted the woman in her 20s, referred to as Ms. A, and a man in his 30s, Mr. B, on April 14 on charges including aggravated robbery, aggravated coercion, and aggravated assault.


The two, who are in a romantic relationship, broke into the home of the victim, Mr. C, on March 22. They tied up Mr. C with duct tape and inflicted injuries with a weapon more than 20 times. They threatened him with the weapon and forced him to make a false confession stating, “I raped Ms. A,” and pressured him to make the same statement at the police station. They also robbed Mr. C of 13 million won in cash.


Their crime began after Ms. A’s accusation against Mr. C for aggravated sexual assault resulted in a decision of no charges. The local police station decided not to refer the case for prosecution, stating that it was difficult to acknowledge the accusation based on audio recordings of their conversations and other evidence. Harboring resentment, Ms. A and Mr. B committed the retaliatory crime to force a false confession from the victim.


The day after the crime, the police urgently arrested and detained the two. The case could have ended as a robbery and assault involving a weapon, but a supplementary investigation by the prosecution uncovered the full story. The prosecution quickly seized the suspects’ mobile phones and launched an extensive forensic analysis.


It was revealed that the suspects had used a private detective agency to track down Mr. C’s new residence, to which he had secretly moved after the sexual assault investigation, and had monitored his movements in person, meticulously planning the crime in advance. The supplementary investigation also secured the audio file of Mr. C’s false confession, which he made under coercion, as key evidence.


The prosecution is also conducting an additional investigation, considering the possibility that Ms. A’s initial report of sexual assault was itself false. The prosecution is actively reviewing whether Ms. A can be charged with false accusation by seizing the victim’s mobile phone and the tools used in the crime. The prosecution stated, “Through an aggressive supplementary investigation, we secured key evidence and uncovered the full circumstances of the crime,” adding, “We will do our utmost to maintain the indictment so that a sentence commensurate with the guilt is handed down.”
