The Venture Business Association has expressed its support for the government's follow-up measures regarding artificial intelligence (AI) policies.
On March 9, the Venture Business Association released a statement, saying, "It is positive that the National Artificial Intelligence Strategy Committee decided, through consultations with relevant ministries on February 26, to swiftly implement follow-up measures for the 'Korea Artificial Intelligence Action Plan.' This is significant as it confirms the government's direction to simultaneously pursue copyright protection and AI innovation amid intensifying global AI competition."
The association stated, "Easing criminal liability risks, promoting the use of works in gray areas such as opt-out, and expanding the use of public works for AI are important measures that will gradually improve the 'legal risks' and 'legitimate data accessibility' concerns faced by companies," adding that "the need for such measures is extremely high."
However, the association emphasized that specific design is needed to ensure the effectiveness of the system. "The opt-out system should be designed in a standardized manner so that both rights holders (platforms) and companies can easily apply it," the association said. "The pre-use, post-compensation system should be made predictable, and public works should be provided in the form of high-quality data that can actually be utilized."
The association also called for improvements to the fair use guidelines. "Legal uncertainties remain regarding the interpretation for commercial purposes, the technical characteristics of AI learning, and methods of collecting publicly posted content," it pointed out.
Finally, the association stated, "The industry will actively cooperate with the government, rights holders, and academia to establish mutually beneficial standards through consultations."
