A famous influencer who was tried for sexually assaulting a woman while drinking together received a suspended prison sentence confirmed by the Supreme Court.
On the 16th, the Supreme Court's First Division (Presiding Justice No Tae-ak) announced that it upheld the lower court's ruling on the 13th of last month, sentencing a man in his 20s, Seo, who was indicted for violating the Special Act on the Punishment of Sexual Crimes, to 1 year and 6 months in prison with a 2-year suspension.
Seo, who has tens of millions of subscribers on TikTok and YouTube, was tried on charges of sexually assaulting a woman he had been drinking with by taking her to the home of an acquaintance, A, in July 2023.
The prosecution charged Seo and A jointly with the crime, applying the charge of special quasi-rape. The first trial court found them guilty and sentenced Seo to 3 years and 6 months in prison.
However, the second trial court stated, "There is no evidence to recognize that the sexual acts were continuous and sequential," and only acknowledged the charge of quasi-rape as guilty, sentencing Seo to 1 year and 6 months in prison with a 2-year suspension. The fact that the victim reached a settlement during the second trial was also reflected in the sentencing.
The prosecution appealed, but the Supreme Court dismissed the appeal, finding no error in the second trial's judgment.
A, who was indicted together with Seo, had a prison sentence of 1 year and 6 months confirmed without suspension.
