Court Rejects Request to Cancel Detention of Former Minister Kim Yong-hyun on 'Rebellion Charges'

The request to cancel the detention of former Minister of National Defense Kim Yong-hyun, who was indicted on charges of insurrection, was dismissed by the court.

On the 20th, the 25th Criminal Division of the Seoul Central District Court (Presiding Judge Ji Gui-yeon) dismissed the request to cancel detention filed by former Minister Kim, who is accused of engaging in important duties related to insurrection, claiming that his detention was unjustified.


The court stated, "There is no reason to cancel the detention as it does not fall under the cases where the grounds for detention under Article 93 of the Criminal Procedure Act are absent or have disappeared." Article 93 of the Criminal Procedure Act stipulates that if the grounds for detention are absent or have disappeared, the court may cancel the detention ex officio or upon request by the prosecutor, defendant, or defense counsel.


Former Minister Kim filed a request to cancel his detention with the court on the 14th. He also filed an appeal against the denial of his bail request, which was dismissed on the 23rd of last month.
