According to the legal community on the 8th, the Seoul High Court Administrative Division 9-2 (Presiding Judges Kim Seung-joo, Jo Chan-young, Kim Mu-shin) dismissed the appeal for a stay of execution against the suspension of medical license filed by former Emergency Response Committee Chairman Kim against the Minister of Health and Welfare on the 5th.
Earlier, the government imposed a 3-month suspension of medical licenses starting from April 15 on former Emergency Response Committee Chairman Kim Taek-woo and former Emergency Response Committee Organizational Strengthening Chairman Park Myung-ha in March, on charges of inciting collective resignation of residents and obstructing work.
In response, they filed a lawsuit to cancel the suspension of their licenses and applied to the Seoul Administrative Court for a stay of execution to temporarily halt the suspension. However, on April 11, the court dismissed all stay of execution requests filed by the two, and they appealed the first trial decision.
At the hearing on May 5, Kim’s legal representative argued, “The statements made at the time were political remarks that could be made as the Emergency Response Committee Chairman,” and “The residents acted separately and were not incited by (Kim’s) statements.”
Park’s appeal for the stay of execution was also dismissed on the 27th of last month.
