Shin Hye-sung Receives Suspended Sentence Again in Appeal Trial... "Drove Someone Else's Car, Refused Breathalyzer Test"

Shinhwa member Shin Hye-sung, who refused the police's request for a breathalyzer test, was sentenced to a suspended prison term again in the appellate court.

On the 12th, the 3rd Criminal Appeals Division of the Seoul Eastern District Court (Presiding Judge Kim Han-seong) sentenced Shin, who was indicted for refusing a breathalyzer test under the Road Traffic Act and illegal use of a vehicle, to six months in prison with a one-year suspension, the same as the first trial. Shin did not respond to reporters' questions, including whether he had anything to say to his fans, when he appeared in court that day.


The court stated, "Even considering all the circumstances that the prosecution particularly emphasized in the appeal trial, the original sentence is not too light to be considered outside the reasonable range of sentencing discretion," and dismissed the prosecution's appeal.


On October 11, 2022, at around 1:40 a.m., Shin was driving a car owned by someone else on his way home. The police responded to a report that "a vehicle was stopped in the middle of the road on Tancheon 2 Bridge in Songpa-gu, Seoul." At that time, the police requested a breathalyzer test, but Shin refused.


Previously, in April 2007, Shin was caught driving under the influence with a blood alcohol concentration of 0.097%, which corresponds to a license suspension.
