The 2nd Truth and Reconciliation Commission on Past Affairs (Truth and Reconciliation Commission) announced on the 25th that it will accept applications for the preparation or correction of family relationship registration records for those recognized as victims through truth verification.
Until now, the Truth and Reconciliation Commission has recommended corrections to the family relationship registration records of victims after investigating cases and making truth verification decisions, but applicants faced difficulties such as having to request corrections from the court. Accordingly, the Truth and Reconciliation Act was amended in 2020 to include a provision on the "preparation and correction of family relationship registration." Based on this, the Supreme Court established related rules in November 2020, and in February of this year, the Truth and Reconciliation Commission prepared related rules through its 51st committee meeting.
Both the 1st and 2nd Truth and Reconciliation Commissions allow victims recognized as such or their relatives to apply for corrections to family relationship registration records. Furthermore, if the Truth and Reconciliation Commission deems it necessary, it can prepare or correct records ex officio without an application from the applicant.
Applications for decisions on the preparation of family relationship registration records can be made when a victim recognized by the Truth and Reconciliation Commission has no record in the family relationship registration. Applications for correction decisions can be made if the place or date of death of the victim, as determined by truth verification, is recorded differently in the family relationship registration. However, this application is only for corrections related to the victim's death records and does not apply to matters such as parent-child relationships or marriage.
To apply, applicants must visit the Truth and Reconciliation Commission in person or submit the application by mail. Along with the application, the applicant must submit a family relationship certificate, the victim's family register extract, and a copy of the truth verification decision notice. If the victim's family register extract is unavailable, a statement explaining the reason must be submitted. Upon receiving the application, the Truth and Reconciliation Commission will review and decide within 90 days and announce the results. The application and the notice of review and decision must be submitted to the city, town, or township office.
