[Asia Economy Intern Reporter Kim Nayeon] A man in his 30s who was charged with causing a disturbance and obstructing business at a chicken restaurant because the chicken was cold was sentenced to a fine.


On the 17th, the Incheon District Court Criminal Division 8 (Judge Lee Daero) announced that it sentenced Mr. A (33), who was charged with obstructing business, to a fine of 2 million won.


Mr. A was charged with obstructing business for about 20 minutes at a chicken restaurant operated by the victim Mr. B (37) located in Seo-gu, Incheon, around 9:50 p.m. on May 7 last year.


According to the investigation, on the day of the incident, Mr. A requested a refund because the chicken he had ordered two days earlier was cold when he ate it. When the request was denied, he shouted loudly, "Do you want to see the store go bankrupt over 20,000 won? Should I destroy the store?" and caused a disturbance at Mr. B's store by throwing the bag containing the purchased chicken toward the kitchen.


The court ruled, "Although Mr. A's side claims there was no intent to obstruct business, Mr. A's actions objectively interfered with the victim's business, and Mr. A was aware of this."


It added, "The defendant requested a refund two days after ordering the chicken, and instead of exercising his rights as a consumer in a proper manner, he obstructed the victim's business and posted leaflets on the street that harshly criticized the victim's store. Even based on the materials submitted by the defendant, there is no evidence that the victim engaged in unfair business practices or treated the defendant inappropriately," explaining the reasons for sentencing.
